This high density TND development will be located between Harrisburg Pike, Logan Rd. And US15 (across form Logan Park). Carroll Township basically signed into an agreement denying public involvement. The township cannot produce documents it do not exist. The time line for the dates has been renegotiated. I expect to maybe hear more on the status of this plan sometime in NOV? 9/02/09 This is a Summary of the Stormwater Management that was apart of our original RTK request the full report was made available and reviewed - only copies of the Summary Stormwater Management Report were requested and received. 8/13/09 CCSG's sends letter to Honorable John Chronister view here we been SLAPPED - Strategic lawsuit against public participation “SLAPP-ed” by the Court? Corporate lawyers have evolved into overwhelming and oppressive manipulators of the public and our court systems. The Average Joe is helpless, hapless, and hopeless in trying to understand and work within the legal machinations re-shaping our communities. One perfect example is the Strategic Lawsuit Against Public Participation ("SLAPP"), intended to intimidate and silence critics. Winning the lawsuit isn’t their goal. Fear, intimidation, mounting legal costs or simple exhaustion can achieve the desired result – to kill public criticism and community opposition. Many states have "anti-SLAPP suit" statutes protecting citizens' rights to free speech and to petition their government. Pennsylvania is one of those states. Yet, a PA judge is preventing public review and criticism of a development plan by allowing “Confidential Mediation” between Carroll Township and Dillsburg Ventures, LLC (Powers Brothers, Maryland). There is an undisclosed timeline for an unknown negotiator to make deals with an out-of-state developer with no interest other than profit. This situation runs contrary to the intent of PA laws protecting citizens’ rights. Most assuredly our Founding Fathers are spinning in their graves. Deana Weaver Letter to negotiator Behind Closed Doors There are currently "behind closed doors" negotiations between Carroll Township and Powers Brothers (Maryland-based developer) for the Village at South Mountain. This is a 236 residential unit development across from Logan Park, with a 40,000+sf shopping center and 600 parking spaces, with one access off Route 15, midway between Harrisburg Pike and Siddonsburg Road. Granting the developer’s appeal of the township’s 2008 denial, the Court guarantees approval of mediation. Citizens are uninformed of the identity of Carroll’s representatives for this mediation. There will be no public review, questions, or input prior to approval. The original timeline was not met, and therefore extended. Initial scheduling would have reached completion on Tuesday, July 14th. The new timeline remains unknown. The original “Negotiation Procedure and Settlement Agreement” is available at CarrollCitizens.com under “Development.” These negotiations have resulted in zoning changes. While the denied plan was a Traditional Neighborhood Design, this negotiated plan is RS2 zoning, which did not exist at the time of original submittal. Unfortunately, the township must apply the previous ordinances which were not written to address RS2 zoning. Worst of all, Carroll Township did not have to agree to these negotiations. They would have faired better to invest in further court proceedings in order to fulfill obligations to protect our health, safety, and welfare. Deana Weaver ..........................
